TERMS AND CONDITIONS FOR DRIGO CAR RENTAL LLC
1. AGREEMENT
DRIGO Car Rental LLC ("DRIGO") is a car rental service introducing a unique concept in the UAE that provides 24/7 access to DRIGO vehicles for its approved Clients. Whether for a business meeting, a late-night outing, or a shopping trip, DRIGO offers convenient transportation accessible anywhere within the designated zones. This service is exclusively available to individuals who have successfully completed the application process and have been registered as "Clients" by DRIGO.
This Agreement governs the legal relationship, rights, and obligations between DRIGO and the Client regarding the use of DRIGO Vehicles. This Agreement itself does not confer an automatic right to use DRIGO vehicles; usage is subject to approval. By accessing or using a DRIGO vehicle, the Client acknowledges, accepts, and agrees to adhere to all Terms and Conditions of DRIGO as set forth in this Agreement.
CLIENT'S DECLARATION
The Client declares that they have received all necessary explanations regarding the content of this Agreement and have carefully reviewed and understood all commitments and obligations herein. The Client acknowledges that this Agreement contains terms related to liability, damages, indemnification, and administrative fees. The Client understands that this Agreement defines their rights and responsibilities in the event of any damage to DRIGO vehicles, third-party property, or violations of traffic laws. By applying for Membership or using a DRIGO vehicle, the Client agrees to the following definitions and terms.
1.1. DEFINITIONS
In this Agreement, except as otherwise expressly provided, or unless the context otherwise requires:
- "Account Page" means the Client's personal dashboard and account section on DRIGO's website or mobile application.
- "Agreement" means this Terms and Conditions Agreement as amended, supplemented, or updated in writing from time to time.
- "Application" means the digital or physical form submitted by the Client for Membership with DRIGO.
- "Driver's License" means a valid official document that authorizes the holder to operate a motor vehicle in the jurisdiction where the DRIGO vehicle is being used.
- "Eligible" or "Eligibility" means a person who meets the specific requirements set forth in Schedule "B" to become a Client.
- "Fees" means all charges, costs, and subscription dues applicable under this Agreement as detailed in the Fees Schedule.
- "Business Zone" means the specific geographical area designated by DRIGO where a Trip can be commenced and terminated.
- "Invoices" means a periodic summary statement generated by DRIGO, detailing all fees, usage charges, and other amounts for which the Client is responsible pursuant to this Agreement.
- "Client" means the party who has entered into this Agreement and has been approved by DRIGO through the application process.
- "Membership Access" means the secure electronic entry provided to a Client, enabling access to a vehicle via the DRIGO Android or iOS App using a unique username and password.
- "Parking Rules" means the regulations issued by the UAE Traffic Police Dept. and municipal authorities, identifying permissible parking locations within the Zone for DRIGO Vehicles.
- "Fleet" means the group of cars available on the mobile application within the Business Zone of a specific operating city.
- "DRIGO Vehicle" means any motor vehicle registered to or managed by DRIGO and used in connection with its rental business, including all hardware installed thereto.
- "Trip Period" means the duration between Vehicle Activation and Vehicle Deactivation.
- "Violation Charge" means specific financial charges applied to a Client for violating DRIGO's terms, intended to cover administrative costs, actual damages, and third-party recovery fees incurred by DRIGO, and is not an interest-based penalty.
1.2. FEES, CHARGES, AND ADMINISTRATIVE COSTS
To ensure transparency and compliance with ethical trading principles, the Client agrees to the following specific charges:
A. Traffic Violations and Administrative Fees
The Client is fully responsible for any traffic violations incurred during the Trip Period. The Client acknowledges that DRIGO is required to process these fines with relevant authorities. Therefore, the Client agrees to pay:
1. The actual amount of the traffic fine imposed by the authority; AND
2. A fixed Admin Fee of AED 100.00 for each violation processed.
(This fee covers the administrative cost and manual processing required to clear the fine).
B. Toll Road Charges (Salik/Darb)
The Client is responsible for all toll road charges incurred during the Trip Period. The Client agrees to pay:
1. The applicable government toll fee; AND
2. A fixed Processing Fee of AED 1.50 per crossing/toll gate.
(This fee remains fixed regardless of the toll amount or time of day).
C. Debt Collection and Recovery Costs
The Client acknowledges that if any due payments are delayed or refused, DRIGO has the right to engage third-party agencies (legal firms, debt collectors) to recover the outstanding amount. In such cases, the Client agrees to pay all actual costs incurred by DRIGO for the recovery process, which may amount to up to 25% of the total outstanding debt. This charge is strictly for cost recovery and service fees paid to third parties, not a penalty interest.
1.3. MODIFICATION OF TERMS
DRIGO reserves the right to amend, supplement, or replace this Agreement from time to time. DRIGO shall provide notice of such material changes to the Client. The Client acknowledges that continued use of DRIGO vehicles following such notice constitutes acceptance of the modified terms.
2. ELIGIBILITY AND AUTHORIZED USE
2.1. ELIGIBILITY REQUIREMENTS
To be eligible to register as a Client and operate a DRIGO Vehicle, the applicant must meet the following strict criteria:
a) Age Requirement: Be at least 23 years of age or older on the date of account activation.
b) License Requirement: Hold a valid driving license that is recognized by the concerned UAE Authorities (RTA).
c) Health & Mental State: Be in a mental and physical state that fully complies with the safety requirements of UAE laws. The Client warrants that they do not suffer from any condition that would impair their ability to drive safely.
ACCEPTED DRIVING LICENSES:
DRIGO accepts valid driving licenses from the UAE and the following countries (subject to current RTA regulations):
Austria, Belgium, Spain, Germany, France, Ireland, Netherlands, Italy, United Kingdom, Turkey, Greece, Switzerland, Norway, Denmark, Sweden, Romania, Poland, Cyprus, Finland, Portugal, Canada, USA, Kuwait, Saudi Arabia, Bahrain, Qatar, Oman, South Korea, New Zealand, Japan, Australia, South Africa.
*Note: DRIGO reserves the right to update this list in accordance with UAE Authority directives.*
The Client declares that they have reviewed these Eligibility Requirements and warrants that they are fully Eligible. The Client agrees to cooperate in providing DRIGO with all necessary information and documents to confirm their Eligibility. DRIGO reserves the right to request additional information at any time and may, at its sole discretion, reject any Client application to protect its assets and public safety.
2.2. ADDITIONAL CRITERIA
The Client acknowledges that DRIGO may add additional requirements to the Eligibility Criteria at any time to ensure higher safety standards. Failure to meet such updated requirements may result in the disqualification of the Client.
2.3. ONGOING ELIGIBILITY AND MONITORING
Since operating a DRIGO vehicle requires maintaining a safe driving record, DRIGO reserves the right to periodically check the Client’s driving records/traffic file. DRIGO may, in its sole discretion, suspend or terminate this Agreement if the Client's risk profile increases. Additionally, DRIGO may at any time require Clients to demonstrate continued compliance with the licensing laws of their jurisdiction of residence.
2.4. LOSS OF ELIGIBILITY AND STRICT PROHIBITIONS
The Client agrees that their right to use a DRIGO Vehicle shall be immediately revoked if:
1. The Client's driving license is suspended, revoked, expired, or becomes invalid;
2. The Client receives any major endorsements or is involved in accidents indicating reckless behavior;
3. The Client is convicted of, or receives a police report for:
a) Driving under the influence of alcohol, drugs, or any intoxicating substances;
b) Dangerous or reckless driving;
c) Exceeding the relevant speed limit significantly.
CRITICAL LIABILITY NOTICE:
The Client agrees to notify DRIGO promptly of any such suspension, conviction, or change in status.
WARNING: If the Client operates a DRIGO Vehicle while under the influence of alcohol or drugs, or in violation of UAE laws, the Client acknowledges that:
1. They are in breach of this Agreement and the Trust ("Amanah");
2. They will NOT be covered by DRIGO's insurance policy;
3. They shall be personally liable for 100% of any damages, third-party claims, blood money (Diya), and legal costs incurred.
The Client must strictly refrain from accessing or using a DRIGO vehicle if they no longer meet the eligibility criteria or legal requirements of the UAE.
3. MEMBERSHIP AND CONTRACTUAL TERMS
3.1. COMMENCEMENT OF AGREEMENT
This Agreement shall officially commence upon DRIGO’s acceptance of the Client’s Application (signified by a confirmation email) OR upon the Client’s first access to the DRIGO App or Vehicle, whichever occurs first. The Agreement shall remain valid and binding until terminated in accordance with the provisions herein.
3.2. COMMUNICATIONS AND NOTICES
DRIGO may contact the Client regarding any matter related to this Agreement or vehicle usage via phone, text message (SMS/WhatsApp), email, or app notifications. The Client explicitly authorizes such contact. The contact details provided by the Client during registration are considered the "Legal Address" for all official notifications.
Responsibility: The Client is required to ensure that their provided communication channels are active and properly working. The Client accepts responsibility for any consequences arising from their failure to receive notifications due to their own device settings, network issues, or outdated contact information.
3.3. TERMINATION BY CLIENT (EARLY TERMINATION)
The Client may terminate this Agreement at any time by providing written notice, paying all outstanding Fees, and returning all DRIGO property.
Early Termination Compensation:
For long-term rental contracts, early termination disrupts DRIGO's operational planning and causes loss of expected revenue. Therefore, strictly as compensation for this opportunity cost (and not as a penalty), the Client agrees to the following charges based on the remaining contract duration:
- 1-3 months remaining: Compensation equal to 1 month's rental fee.
- 6 months or more remaining: Compensation equal to 2 months' rental fee.
3.4. PROHIBITION OF UNAUTHORIZED COMMERCIAL USE
DRIGO prohibits the use of its vehicles for any unauthorized commercial gain. "Exploiting use" is strictly defined as using the vehicle for:
1. Taxi services (e.g., Uber, Careem) without DRIGO's written consent;
2. Commercial delivery services;
3. Sub-leasing to third parties.
If DRIGO believes there is a violation of this clause, it reserves the right to immediately prohibit continued use, immobilize the vehicle, and notify relevant authorities. Such usage is considered a breach of Trust ("Amanah").
3.5. TERMINATION BY DRIGO
DRIGO may terminate this Agreement or suspend the Client's access immediately if the Client:
1. Fails to pay any Fee when due;
2. Violates any term of this Agreement, including the Terms of Use;
3. Fails to maintain Eligibility (e.g., License expiry);
4. Returns the Vehicle to a prohibited location outside the Business Zone;
5. Fails to disclose defects affecting the safety of the Vehicle (Concealment);
6. Has provided false or misleading information during registration (Fraud).
3.6. RETURN OF PROPERTY
Upon termination or suspension, the Client must immediately return the DRIGO Vehicle and any other company property (keys, documents, fuel cards) in their possession.
3.7. RECOVERY COSTS AND LEGAL FEES
If the Client fails to return the vehicle or pay outstanding dues, DRIGO reserves the right to take possession of the Vehicle at the Client’s expense.
Fairness Clause: The Client agrees to pay any reasonable and actual legal fees, court costs, and vehicle recovery expenses incurred by DRIGO in enforcing this Agreement. DRIGO shall not charge arbitrary fees beyond the actual costs sustained due to the Client’s breach.
4. USE OF DRIGO VEHICLES AND PARKING RULES
4.1. ACKNOWLEDGEMENT OF LIABILITY
The Client acknowledges reading and understanding the Terms of Use. By unlocking and initiating the use of a DRIGO vehicle, the Client explicitly agrees that:
1. They are the sole operator of the vehicle during the rental period;
2. Any Traffic Fines, "Black Points," or Impounding Charges accrued during the Trip Period (until the vehicle is properly returned and the trip is ended in the App) are the Client’s sole responsibility.
Authorization: The Client consents to the automatic transfer of all such fines and Black Points to their traffic file/license without the need for further consultation. If automatic transfer is not possible, the Client agrees to pay the fine amount plus the DRIGO Administrative Fee immediately.
4.2. OWNERSHIP AND INTELLECTUAL PROPERTY
This Agreement grants the Client a temporary right of use (Usufruct) but strictly NO ownership rights. The DRIGO Vehicle, including its on-board computer, GPS trackers, and activation systems, remains the exclusive property of DRIGO.
The Client agrees NOT to tamper with, disconnect, modify, or reverse engineer any equipment installed in the vehicle. Any such attempt is considered damage to property ("Itlaf") and will result in legal prosecution and full compensation for damages.
4.3. PARKING RULES (STRICT COMPLIANCE)
To ensure the vehicle remains accessible for the next user and to maintain GPS connectivity, the Client must strictly adhere to the following parking rules.
A. PERMITTED PARKING ZONES (Where to Park)
The Client shall park the vehicle ONLY in:
1. Public parking areas designated as "Free" or covered by DRIGO’s digital permit;
2. Zones explicitly marked as "Allowed" within the DRIGO Mobile Application business map.
*Note: Since municipal parking codes (e.g., Zone A, B, C) may change, the Client must refer to the DRIGO App for the most current authorized zones.*
B. PROHIBITED PARKING AREAS (Where NOT to Park)
Parking in the following areas is STRICTLY PROHIBITED:
1. Private Parking, Resident-Only Parking, or assigned slots;
2. Underground Basements, Multi-level Car Parks, or enclosed structures with roofs (Mall Parking);
3. Any area where GPS/GSM signal is blocked;
4. Disabled Parking slots (unless the Client has a valid permit);
5. Valet Parking areas.
4.4. OPERATIONAL VIOLATION CHARGES (NON-TRAFFIC FINES)
Even if no traffic fine is issued by the Authorities (Police/RTA), the Client acknowledges that improper parking causes operational loss to DRIGO (e.g., vehicle becomes invisible on the App due to signal loss, or requires towing). Therefore, the Client agrees to pay an Operational Violation Fee (as per the Fees Schedule) in the following cases:
1. Signal Loss: Ending a trip in a basement/underground parking where the vehicle cannot be tracked.
2. Relocation: Parking in a restricted area that requires DRIGO team to relocate the vehicle.
3. Impounding: Any action leading to the vehicle being impounded by authorities. The Client is liable for the full impounding fee + loss of rental revenue for the days the car is impounded.
4.5. APPEALS POLICY
Any imposed fines paid by DRIGO on behalf of the Client must be reimbursed by the Client immediately. If the Client wishes to appeal a fine:
1. The Client must first settle the amount with DRIGO to avoid late penalties.
2. Upon successful appeal and cancellation of the fine by the Authority, DRIGO guarantees to refund the full amount to the Client immediately.
5. COMMENCING A TRIP AND VEHICLE ACCEPTANCE
5.1. VEHICLE RESERVATION
A DRIGO Vehicle may be reserved by a Client through the DRIGO smartphone application.
- Reservation Window: Each reservation grants a maximum 15-minute window to reach the vehicle and start the trip.
- Charges: If the trip is taken, there is no separate charge for the reservation.
- Multiple Reservations: To prevent monopoly and harm to other users ("Darar"), making multiple simultaneous reservations is strictly prohibited. DRIGO reserves the right to charge fees for multiple dummy reservations as per the Pricing List.
5.2. USE WITHOUT RESERVATION
The Client may request the immediate use of any DRIGO Vehicle without prior reservation, provided such vehicle is marked ‘Available’ on the App.
5.3. INSPECTION FOR DAMAGE (CLIENT'S DUTY)
Before operating a DRIGO Vehicle, the Client is Islamically and contractually obligated to inspect the interior and exterior for any visible defects, damages, or excessive soiling. Reporting Channels: Any defect, damage, or issue with the vehicle MUST be reported before unlocking and starting the trip, either through the in-App "Report a Problem" feature (with photographic/video evidence) or by contacting DRIGO Customer Support. Shift of Liability for Late or Missing Reports: If the Client unlocks the vehicle and commences the trip without first reporting a pre-existing issue, or reports it only after a delay during which the condition could have changed, the Client shall be deemed to have accepted the vehicle in its observed condition. In such cases, full responsibility and liability for the unreported defect, damage, or soiling shall rest with the Client.
5.4. VEHICLE CLEANLINESS AND "UNFIT FOR USE" POLICY
DRIGO relies on its Clients to return vehicles in a clean state ("Amanah"). Generally, the Client accepts the use of a DRIGO Vehicle on an ‘as is, where is’ basis.
EXCEPTION (Refusal Rights & Refunds — Post-Unlock Cleanliness Issues): If, after the Client has rented and unlocked the vehicle, the Client discovers that the vehicle is in a condition that renders it "Unfit for Use" (e.g., strong cigarette odor, severe uncleanliness, presence of impurities), the Client has the right to refuse the vehicle and request a refund, subject to the following strict conditions:
1. Do NOT Move the Vehicle: The Client must NOT drive or relocate the vehicle from its parked position. Once the vehicle is moved, the Client is deemed to have accepted the vehicle in its current condition and this refund right is forfeited; the trip will be billed normally.
2. Proof: The Client must immediately upload clear photographic and/or video evidence of the unclean condition to the DRIGO App/System.
3. Notification: The Client must cancel the trip immediately and report the issue via the in-App "Report a Problem" feature or by contacting DRIGO Customer Support.
4. Refund: In such verified cases (where the uncleanliness is substantiated by the submitted evidence), NO rental fee shall be charged. If the System has automatically deducted any amount, DRIGO guarantees to refund the full amount after verifying the evidence. The refund will be issued to the Client's original payment method and typically reflects within 5–10 banking business days, depending on the Client's issuing bank's settlement cycle. DRIGO has no control over this bank-side timeline once the refund has been released from DRIGO's side.
5.5. INOPERABLE VEHICLES
If the reported defects render the vehicle unsafe or inoperable, DRIGO will endeavor to assign a different vehicle within a reasonable distance, subject to availability.
5.6. VEHICLE ACTIVATION
Upon proper activation via the App, the DRIGO Vehicle will automatically unlock. This action signifies the commencement of the "Trip Period."
5.7. COMMENCEMENT OF FEES
Fees shall accrue from the moment of Vehicle Activation.
- Liability: Fees apply even if the vehicle is unlocked but not driven (as the vehicle was held exclusively for the Client).
- Unauthorized Use: Fees will accrue even if the vehicle is used in breach of this Agreement by a person other than the Client.
5.8. AREA OF OPERATION (BUSINESS ZONES)
The Client may drive the DRIGO vehicle within the UAE but MUST end the trip and return the vehicle only within the designated Business Zone where the trip started (as shown in the App). Violation Consequences: If the Client leaves the vehicle outside the Business Zone:
1. The Client remains liable for rental charges until the vehicle is returned to the Zone.
2. The Client is personally responsible for all costs associated with retrieving the vehicle, including towing services and operational disruption fees. Strict Prohibition: Taking a DRIGO vehicle outside the UAE borders is strictly prohibited and will be treated as theft.
6. ENDING A TRIP AND VEHICLE RETURN
6.1. VEHICLE DEACTIVATION (ENDING THE TRIP)
The trip is officially ended ONLY when the DRIGO Mobile Application confirms "Vehicle Deactivation" and indicates the vehicle is successfully locked and available for other clients. Client Responsibility: It is the Client’s sole responsibility to verify that the trip has ended in the App. If the Client fails to initiate Deactivation properly, the Trip Period shall continue, and the Client shall be liable for all accumulated fees until the vehicle is properly secured and the trip is closed on the system.
6.2. OBLIGATIONS UPON RETURN
When the Client wishes to end a trip, they act as a Trustee ("Amin") and must strictly ensure the following:
1. Park Correctly: The vehicle must be parked in accordance with Section 4 (Parking Rules) and within the allowed Business Zone.
2. Secure Key: The Key and Key Fob must be securely returned to their designated slot inside the vehicle.
3. Secure Vehicle: All windows, doors, sunroofs, and trunks must be fully closed, and all lights turned off.
4. Cleanliness: Remove all trash and personal belongings.
5. Fuel Level: Ensure the fuel level is at least 15% (or 20% for EVs) when ending the trip. Failure to maintain this minimum level constitutes negligence and will incur a "Low Fuel Fee" as per the Fees Schedule.
6.3. FLEXIBLE DURATION AND DAILY PAYMENT SECURITY
A. UNLIMITED DURATION (Subject to Payment)
Unlike traditional rentals, DRIGO does not impose a strict 2-day limit. The Client is permitted to keep the vehicle for as long as needed (e.g., 3 days, a week, or more), PROVIDED THAT the daily rental fees are successfully collected by the System.
B. DAILY PAYMENT CYCLE AND IMMOBILIZATION To prevent the accumulation of debt, the Client agrees to the following "Daily Capture" mechanism:
1. Daily Charge: For any rental extending beyond 24 hours, the System will automatically attempt to charge the Client's registered card for the accrued amount (or the upcoming day's fare) exactly at the end of each 24-hour cycle.
2. Payment Failure Consequences: If the automatic payment attempt fails for any reason (insufficient funds, blocked card, etc.):
a) The Client will receive an immediate notification to update the payment method.
b) Immobilization: If payment is not settled immediately, DRIGO reserves the right to remotely immobilize (disable) the vehicle's engine. The vehicle will NOT restart until the outstanding balance is cleared.
3. Rental Termination: If the payment remains unpaid for more than 4 hours after immobilization, DRIGO deems the contract terminated and will initiate vehicle recovery procedures at the Client's expense.
6.4. RETURN TO THE ZONE & CONNECTIVITY
The trip can only be ended if the DRIGO Vehicle is:
1. Located within the designated Business Zone boundaries; AND
2. Able to establish a connection with the cellular network (online).
Connection Failure: If the vehicle is in a "Dead Zone" (no signal) and cannot end the trip, the Client must move the vehicle to an area with better reception. If the issue persists, the Client must contact Customer Service immediately. *Note:* Leaving the vehicle in a no-signal area without ending the trip properly will result in continued billing and potential recovery charges.
7. FEES, PAYMENTS, AND WALLET POLICY
7.1. FEES AND ACCRUAL
The Fees for using a DRIGO Vehicle are strictly governed by the Pricing Schedule active at the commencement of the trip. The Client agrees to pay all amounts when due.
- Accrual: Fees begin to accrue immediately upon Vehicle Activation and are payable in full at the end of the Trip Period (or daily, as per Section 6.3).
7.2. INVOICING AND TRANSPARENCY
Upon ending the trip, the Client will receive a digital trip summary via email/App.
- Variable Charges: Tolls (Salik/Darb), Traffic Fines, and Fuel surcharges are added separately based on actual usage/occurrence.
- Admin Fees: The Client acknowledges that DRIGO applies a fixed Administrative Fee on top of Tolls and Fines (as defined in Section 1) to cover processing costs.
7.3. PAYMENTS AND AUTOMATIC CAPTURE
Payments shall be made by Valid Credit/Debit Card (Visa, MasterCard) authorized by DRIGO. Authorization: The Client hereby irrevocably authorizes DRIGO to:
1. Store the payment method details securely via a licensed Payment Gateway;
2. Automatically charge the Client for all rentals, fines, tolls, and penalties incurred;
3. Reserve Credit (Pre-Auth): Place a temporary hold (Security Deposit) on the Client’s card up to 24 hours before or during the trip to ensure fund availability. Declined Payment: If a charge is declined, DRIGO reserves the right to suspend the account and immobilize the vehicle immediately as per Section 6.3.
7.4. BILLING HISTORY
Full transparency is provided via the "History" section in the DRIGO App, where the Client can access all past Invoices and transaction logs.
7.5. REFUNDS, APPEALS, AND WALLET POLICY
A. Refund Requests: Any objection to an Invoice must be communicated to DRIGO via email within 7 days.
- Guarantee: If an error is verified (e.g., system glitch, overcharge), DRIGO guarantees to refund the excess amount.
- Refund Processing Time: Once a refund has been approved and released by DRIGO, the amount is returned to the Client's original payment method. The funds typically appear in the Client's account within 5–10 banking business days, depending entirely on the issuing bank's settlement cycle. DRIGO has no control over the bank-side processing timeline and shall not be held liable for delays caused by the Client's bank.
- Dispute: The Client agrees NOT to initiate a bank "Chargeback" without first contacting DRIGO. Unjustified chargebacks will be considered a debt and claimed legally.
B. DRIGO Wallet (Credits) Policy - Sharia Compliant: To ensure fairness, DRIGO distinguishes between two types of credits:
1. "Cash Balance" (Top-Up): Money directly deposited by the Client. This IS refundable upon account closure (subject to clearing outstanding dues).
2. "Promo Balance" (Bonus): Credits given by DRIGO as a gift, promotion, or compensation. These are:
- NOT exchangeable for cash;
- NOT transferable to others;
- Subject to an expiration date;
- Used only for rental charges (not for Fines/Salik).
- Priority: The System will always deduct from the "Promo Balance" first before touching the "Cash Balance."
7.6. UPDATING PAYMENT METHODS
The Client is religiously and contractually responsible for ensuring their registered card is valid and has sufficient funds. Failure to update expired card details may result in account termination and legal debt recovery.
7.7. DEBT COLLECTION AND RECOVERY AGENTS
If the Client fails to settle outstanding dues within the stipulated time, DRIGO reserves the right to assign the debt to a regulated third-party Collection Agency or Legal Firm. Client Liability: The Client acknowledges and agrees to pay:
1. The full outstanding principal amount; AND
2. The actual collection fees charged by the third-party agency (which serves as compensation for the cost of recovery, strictly not as interest/Riba). *Note: As per Section 2, these recovery costs may amount to up to 25% of the total debt.*
7.8. CONSEQUENCES OF UNPAID TRAFFIC FINES
The Client acknowledges that outstanding traffic fines represent a direct financial obligation to DRIGO (as the registered vehicle owner). Therefore, if any traffic fines remain unpaid by the Client beyond the stipulated payment period:
A. Engine Immobilization: DRIGO reserves the right to remotely immobilize (disable) the vehicle's engine until all outstanding fines and associated Administrative Fees are settled in full. The vehicle will NOT restart until the Client's fine balance is cleared to zero.
B. Fuel Privilege Suspension: The Client's access to DRIGO's complimentary fuel benefit (fuel card / free refueling allowance) shall be immediately suspended upon detection of any unpaid fine. This privilege will only be reinstated once all outstanding fines and fees have been fully settled.
Responsibility: The Client acknowledges that these measures are necessary to protect DRIGO's assets and ensure compliance with UAE traffic regulations. Continued accrual of fines without payment constitutes a breach of trust ("Amanah") and may result in further action under Section 3.5 (Termination by DRIGO).
8. PREMIUM INSURANCE COVERAGE AND LIABILITY
8.1. ELIGIBILITY FOR PREMIUM INSURANCE COVERAGE
DRIGO automatically provides Premium Insurance Coverage at no additional cost to every Client who satisfies all of the following conditions:
1. Is at least 23 years old;
2. Holds a valid driver's license recognized by UAE authorities;
3. The driver's license has been issued more than six (6) months ago;
4. Strictly abides by all Terms and Conditions of this Rental Agreement.
No separate purchase, opt-in, or add-on payment is required. Clients whose license has been issued less than six (6) months ago are NOT covered by this insurance and remain personally liable for 100% of any damages (see Section 8.3.8).
8.2. SCOPE OF COVERAGE (WHAT IS COVERED)
Premium Insurance Coverage limits the Customer's financial liability for damage to the DRIGO Vehicle.
- Inclusions: The coverage applies to damages to the DRIGO vehicle resulting from accidental collisions, vandalism, theft, or natural disasters, provided that the Police are notified at the time of the accident and a valid Police Report is submitted.
- Exclusions: The coverage strictly applies to the vehicle body. It DOES NOT cover personal injury (PAI), third-party liability (TPL), windshields, tires, rims, or undercarriage damage unless specified in a separate premium package.
8.3. EXCLUSIONS (WHAT IS NOT COVERED)
Premium Insurance Coverage is VOID (Invalid) and the Customer will be liable for 100% of damages in the following cases:
1. Negligence: Damage caused by willful misconduct, drifting, or gross negligence.
2. Intoxication: Driving under the influence of alcohol, drugs, or medications.
3. Unauthorized Driver: If the vehicle is driven by anyone other than the registered Client.
4. Off-Road: Driving on unpaved roads, desert, or race tracks.
5. Interior Damage: Stains, burns, or tears caused by smoking, pets, or food.
6. Operational Costs: The coverage does not cover towing fees, impound fees, or storage costs resulting from the Customer's fault.
7. No Police Notification / No Police Report: Failure to notify the Police at the time of the accident or failure to provide a valid Police Report for any accident.
8. Inexperienced Driver (Less Than 6 Months License): If, at the time of the accident, the Customer's driving license has been issued for less than six (6) months, the Premium Insurance Coverage shall NOT apply. In such cases, the Customer is fully and personally liable for 100% of all damages, third-party claims, and related costs, regardless of fault.
8.4. CUSTOMER RESPONSIBILITIES IN CASE OF ACCIDENT
In the event of an accident, the Customer MUST:
1. Not move the vehicle (unless ordered by Police).
2. Immediately contact the Police (999) at the time of the accident and notify DRIGO Support.
3. Obtain a Police Report documenting the incident.
4. Submit photos and the report to DRIGO within 24 hours. *Failure to notify the Police at the time of the accident or to obtain a Police Report voids all insurance coverage, making the Customer fully liable.*
8.5. INSURANCE EXCESS (DEDUCTIBLE) AND LOSS OF USE
Premium Insurance Coverage is activated only when the Police are notified at the time of the accident and a valid Police Report is provided. When the coverage is activated, the Customer remains responsible for the following mandatory amounts for each "At-Fault" or "Unknown Third Party" claim:
1. Insurance Excess: A fixed deductible of AED 1,000 + 5% VAT (total AED 1,050) per incident, regardless of vehicle category.
2. Loss of Use (Daily Rental Fee): A daily rental fee equal to the Vehicle's standard daily rate, payable for each day the Vehicle is in the workshop for repair, calculated from the date the Vehicle enters the workshop until it is returned to service.
If the Police are NOT notified at the time of the accident, the insurance does not apply and the Customer is personally liable for 100% of the repair cost, third-party claims, and related expenses.
8.6. TERMINATION OF COVERAGE
DRIGO reserves the right to terminate the Premium Insurance Coverage immediately if the Customer breaches this Agreement (e.g., drunk driving).
- Effect: Upon termination, the Customer becomes personally liable for any NEW damages occurring after the breach. Damages occurred prior to the breach (while the coverage was valid) remain covered, provided they were not caused by the breach itself.
8.7. GOVERNING LAW
These Terms shall be governed by the laws of the United Arab Emirates and the Emirate of Dubai.
9. COLLISIONS, DAMAGE, AND TRAFFIC VIOLATIONS
9.1. LIABILITY FOR UNINSURED DAMAGE
The Client acts as a Trustee ("Amin") for the vehicle. Therefore, the Client is solely responsible for all costs related to damages NOT covered by insurance (including major soiling) incurred during the Trip Period. The Client is responsible for the full costs of:
1. Actual Repair Costs: The actual amount paid to repair the DRIGO Vehicle and third-party property (based on official workshop invoices);
2. Third-Party Injuries: Compensation for bodily injuries or death caused to third parties (if insurance coverage is void due to the Client's breach);
3. Recovery Costs: Costs associated with the towing, recovery, or transportation of the vehicle;
4. Loss of Use: Compensation for the revenue lost while the vehicle is under repair and unavailable for rent.
9.2. DAMAGE FEES AND TRANSPARENCY
Unlike other operators, DRIGO adheres to strict transparency principles.
- Actual Costs: If damage occurs, the Client is responsible for the Actual Repair Cost + Administrative Fee + Loss of Use.
- Estimation & Refund: DRIGO may charge an initial estimated amount based on authorized workshop quotations. However, if the final actual cost is lower than the estimate, DRIGO guarantees to refund the difference to the Client.
- Proof of Cost: Upon request, DRIGO will provide the Client with a copy of the workshop invoice or official assessment report. We do NOT hide repair costs.
9.3. LOSS OF INSURANCE COVERAGE
In the event that any loss or damage occurs during a Trip Period and insurance coverage is lost (voided) due to the Client's actions (e.g., drunk driving, unauthorized driver, off-roading), the Client becomes personally liable for 100% of the total costs of such loss or damage.
9.4. PRESUMPTION OF LIABILITY
If damage is reported or recorded by DRIGO, the last person to use the vehicle is presumed to be responsible, unless:
1. The Client had uploaded "Before" photos showing the damage existed prior to their trip; OR
2. The Client provides evidence (e.g., CCTV, Police Report) proving they were not at fault. *Therefore, it is mandatory to upload photos before starting the trip to protect yourself.*
9.5. LOSS OF PROPERTY
The Client is solely responsible if they lose any of the DRIGO Vehicle’s assigned property (Car Key, Documents). The Client shall pay the full replacement cost plus recoding fees. *Note:* DRIGO is not responsible for any personal items left by the Client in the vehicle.
9.6. REPORT OF DAMAGE
The Client shall promptly report to DRIGO all collisions, accidents, defects, or damage to the vehicle. Mandatory Upload: The Client MUST upload photos of the vehicle (Before & After reservation) via the App. Failure to do so may result in the Client being held liable for damages found after their trip.
9.7. POLICE REPORTS (MANDATORY)
UAE Law requires a Police Report for ANY accident.
1. Duty: The Client must remain at the scene and contact the Police (999).
2. Submission: The Client must obtain the Police Report and submit a copy to DRIGO within 24 hours (or maximum 5 business days).
3. Consequence: If the Client fails to provide a Police Report, the Insurance Company will reject the claim. In this case, the Client becomes personally liable for 100% of the damage costs.
4. Failure to Notify / Withholding Information: If the Client fails to notify the Police at the time of the accident, or fails to report the incident and provide the required information to DRIGO within the stated timeframe, an additional administrative penalty of AED 1,000.00 shall apply, in addition to the Client's full liability for the damage costs.
9.8. ENTITLEMENT TO COMPENSATION
DRIGO is entitled to any compensation paid in connection with damages to its vehicle. If the Client receives any such monies from third parties, they agree to hold such monies in trust and promptly pay them to DRIGO.
9.9. COVERAGE
DRIGO provides Comprehensive Insurance coverage for its fleet, subject to the terms of the Insurance Policy and this Agreement.
9.10. INSURANCE EXCESS (DEDUCTIBLE) AND LOSS OF USE
In accordance with UAE Insurance policies, the Client is liable to pay the "Excess Fee" (Deductible) of AED 1,000 + 5% VAT (total AED 1,050) plus a daily rental fee for each day the Vehicle is in the workshop for repair (Loss of Use), in the following cases:
1. At-Fault Accident: The Police Report states the Client is at fault (Red/Pink Slip).
2. Unknown Third Party: The vehicle was damaged by an unknown person/object (e.g., hit-and-run while parked).
3. Non-Fault: If the Client has a Green Slip AND the third party is identified, the Client pays NOTHING for the Excess Fee; however, the Loss of Use charge may still apply where the third party's insurer does not reimburse the downtime. *Note:* Any fines or penalties paid by DRIGO to authorities must be reimbursed by the Client immediately.
9.11. DAMAGES AND CLIENT RESPONSIBILITY
The Client shall be responsible to DRIGO for any theft of or damage to the vehicle during the Trip Period. Transparency Clause: Unlike the original policy, DRIGO WILL share internal invoices or proof of payments related to repairs upon the Client's request, ensuring that the Client only pays for the actual damage caused.
10. LIABILITY AND INDEMNIFICATION
10.1. LIMITATION OF DRIGO’S LIABILITY
Notwithstanding anything to the contrary expressed or implied in this Agreement, to the fullest extent permitted by applicable UAE laws:
A. EXCLUSION OF INDIRECT DAMAGES DRIGO shall not be liable to the Client for any indirect, incidental, special, or consequential damages, or any economic losses of any kind (including but not limited to loss of profits, business opportunities, missed flights, or loss of data), arising from this Agreement or the Client’s use of a DRIGO Vehicle, regardless of whether such liability arises in contract, tort, or otherwise.
B. LIMITATION OF DIRECT LIABILITY In all other cases not excluded above, DRIGO’s total aggregate liability shall be limited to the amount of Rental Fees paid by the Client for that specific trip.
C. EXCEPTION (MANDATORY LIABILITY)
However, in accordance with the principles of Justice and UAE Law, nothing in this Agreement shall exclude or limit DRIGO's liability for:
1. Death or personal injury caused directly by DRIGO's proven negligence (e.g., failure to maintain the vehicle);
2. Fraud or fraudulent misrepresentation by DRIGO.
11. INDEMNITY (CLIENT'S RESPONSIBILITY)
11.1. CLIENT'S OBLIGATION TO INDEMNIFY
The Client acknowledges their personal responsibility for the proper use of the vehicle. Accordingly, the Client agrees to indemnify, defend, and hold harmless DRIGO (including its affiliates and staff) from any and all claims, liabilities, fines, penalties, and legal costs arising directly or indirectly from:
1. Client's Breach: Any violation by the Client of the terms of this Agreement;
2. Client's Misuse: Any negligent or unauthorized use of the Vehicle by the Client or their passengers;
3. Traffic & Legal Violations: Any fines, impound fees, or legal judgments resulting from the Client’s driving behavior or non-compliance with UAE Traffic Laws.
*This clause ensures that the Client remains accountable for their own actions and decisions during the rental period.*
11.2. VIOLATION OF EMIRATES REGULATIONS AND COMPENSATION FOR LOSS TO DRIGO
In addition to clause 11.1 above, the Client expressly acknowledges and agrees that:
1. Compliance Duty: The Client shall at all times comply with all applicable rules, regulations, decrees, circulars, and administrative instructions issued by the competent authorities of the United Arab Emirates and of any individual Emirate (including, without limitation, the regulations of the RTA, Dubai Police, Sharjah Police, the Ministry of Interior, and the relevant municipal authorities).
2. Statutory Fines & Penalties: Any fine, penalty, administrative sanction, vehicle impoundment, black-point endorsement or other measure imposed by such authorities as a result of the Client's act or omission shall be borne solely by the Client. The Client shall reimburse DRIGO in full for any amount paid by DRIGO to such authorities on the Client's behalf, together with the Administrative Fee set out in Schedule A.
3. Direct Loss to DRIGO: In addition to the statutory fines and penalties referred to above, the Client shall also compensate DRIGO for any direct loss or damage sustained by DRIGO as a consequence of such breach, including (without limitation): loss of use of the Vehicle during impoundment; cost of recovery, towing and re-registration; depreciation; reputational harm requiring corrective communication; and any administrative effort reasonably incurred by DRIGO in dealing with the relevant authority.
4. Cumulative Liability: The Client's liability under this clause 11.2 is in addition to (and not in substitution for) any other liability set out in this Agreement, including the penalties under clauses 13.3, 13.3-A, 13.3-B and Schedule A.
12. INTERPRETATION AND GENERAL PROVISIONS
12.1. INTERPRETATION GUIDELINES
In this Agreement, clarity is key. Unless the context requires otherwise:
1. Headings: The headings (titles) are for convenience only and do not limit the legal scope of the clauses.
2. Inclusivity: Words importing the singular include the plural, and vice versa. Words importing one gender include all genders.
3. "Including": The word "including" means "including but not limited to." It is not an exhaustive list.
4. Statutes: Any reference to a law includes any future amendments or replacements of that law.
12.2. SEVERABILITY (VALIDITY OF REMAINING TERMS)
If any specific term of this Agreement is found by a court to be invalid or unenforceable, that specific term shall be removed. However, the remaining terms shall continue to be fully valid and binding. The contract does not "collapse" due to one void clause.
12.3. ENFORCEMENT OF REMEDIES
DRIGO’s rights and remedies in this Agreement are cumulative. Using one legal remedy (e.g., claiming damages) does not prevent DRIGO from using other remedies (e.g., terminating the account or reporting to Police) concurrently or successively.
12.4. NON-WAIVER (NO RELAXATION OF RIGHTS)
If DRIGO chooses not to enforce a strict rule immediately (e.g., forgiving a late fee once), this does NOT mean DRIGO waives its right to enforce that rule in the future. Flexibility in one instance does not create a permanent exemption.
12.5. FURTHER ASSURANCES & POLICE AUTHORITY
The Client agrees to execute any further documents reasonably requested by DRIGO to protect the rights created by this Agreement. Authority Check: The Digital Contract within the DRIGO App serves as a valid rental agreement. The Client must present this Digital Agreement to Law Enforcement Officers upon demand.
12.6. NOTICES AND COMMUNICATION
A. From DRIGO to Client: Notices shall be deemed validly delivered if sent via:
1. DRIGO App Push Notifications;
2. Registered Email Address;
3. WhatsApp / SMS to the registered phone number.
B. From Client to DRIGO: Official notices must be sent to:
- Email: [email protected]
- Physical Address: Kasco Tower - Al Qusais, Dubai, U.A.E.
12.7. APPLICABLE REGULATIONS AND DISPUTE RESOLUTION
This Agreement constitutes a commercial contract executed within the Emirate of Dubai.
1. Regulatory Compliance: The operational aspects of this Agreement (including traffic rules, commercial licensing, and insurance procedures) are subject to the administrative regulations currently in force in the United Arab Emirates.
2. Dispute Resolution: In the event of any dispute that cannot be resolved amicably, the parties acknowledge that the competent authorities in Dubai shall serve as the venue for resolution and enforcement.
12.8. ENTIRE AGREEMENT
This Agreement, along with the Privacy Policy and Fees Schedule, constitutes the entire agreement between the parties. There are no hidden verbal agreements or secret understandings. Everything is written here for transparency.
12.9. BINDING AGREEMENT
The terms of this Agreement are legally binding contractual obligations, not merely informational statements.
12.10. SUCCESSORS AND ASSIGNS
This Agreement benefits and binds the parties and their respective heirs, personal representatives, and successors.
12.11. ASSIGNMENT (NO SUB-LEASING)
This Agreement is strictly personal to the Client. Prohibition: The Client may NOT transfer, assign, or sub-lease the vehicle or this Agreement to any other person without DRIGO’s prior written consent. Giving the car to another person is a breach of trust.
12.12. CURRENCY
All monetary amounts referred to in this Agreement are in UAE Dirhams (AED).
13. TERMS OF USE: OBLIGATIONS AND PROHIBITED CONDUCT
13.1. CLIENT'S OPERATIONAL OBLIGATIONS
During the rental period, the Client acts as a Trustee ("Amin") and MUST:
1. Careful Use: Handle the vehicle gently, maintain cleanliness, and strictly adhere to UAE Speed Limits and Traffic Laws.
2. Reporting: Immediately notify the Police (999) and DRIGO in case of any accident, damage, or theft.
3. Security: Ensure windows are closed and doors are locked when leaving the vehicle. The Client is liable for theft if the car is left unlocked.
4. Refueling (If applicable):
- Use only the authorized Fuel Cards provided in the vehicle.
- Refuel ONLY at designated stations (e.g., ADNOC/ENOC as specified on the card).
- Prohibition: Using the DRIGO Fuel Card to refuel another vehicle is THEFT and will be prosecuted.
5. Parking: Park only in designated, legal, and safe areas.
- Note: Avoid underground parking without signal where possible to ensure the vehicle remains connected to the System.
6. Fines & Citations: The Client is responsible for all traffic fines, parking tickets, and impound fees incurred during the trip. The Client must notify DRIGO of any tickets immediately.
7. Account Security: Keep the App login, PIN, and Password strictly confidential. If the Client suspects their account is compromised, they must change the password immediately.
13.2. PROHIBITED CONDUCT (ZERO TOLERANCE)
The Client shall NOT, under any circumstances:
1. Intoxication (Strictly Haram & Illegal): Drive under the influence of alcohol, drugs, narcotics, or any medication that impairs driving ability. DRIGO has a ZERO-TOLERANCE policy.
2. Sub-Leasing (Breach of Trust): Allow ANY third party (even another DRIGO user) to drive the vehicle initiated under the Client's account. The account holder is the sole authorized driver.
3. Commercial Use: Use the vehicle for "taxi" services (transporting passengers for hire), delivery services, driving lessons, or towing other vehicles/trailers.
4. Off-Roading: Drive on unpaved roads, deserts, beaches, or participate in races/drifting.
5. Cleanliness & Smoking: Smoke (including e-cigarettes/vape) inside the vehicle or transport pets (unless in a secure carrier). The vehicle must remain clean for the next user.
6. Modifications: Perform any repairs, modifications, or remove any equipment/stickers from the vehicle.
7. Abuse & Communication Misconduct (Zero Tolerance):
A. Prohibited Behaviour: The Client shall NOT engage in any of the following conduct when communicating with DRIGO staff via any channel (Support Chat, WhatsApp, Phone, Email, or in person):
1. Using profanity, insults, vulgar language, or offensive remarks directed at DRIGO staff or the company;
2. Making threats of any kind, including threats of violence, legal action without basis, or threats to damage DRIGO's reputation;
3. Review Blackmail: Threatening to post negative reviews, public complaints, or social media posts as a means to obtain concessions, discounts, fee waivers, or preferential treatment. Such conduct constitutes coercion and will be treated as a serious breach of this Agreement;
4. Sending excessive repeated messages ("spam messaging") to pressure staff into expediting a response or bypassing company policy;
5. Using discriminatory, racist, or sexually inappropriate language.
B. Recording Notice: The Client acknowledges and agrees that all support conversations (including chat messages, WhatsApp exchanges, phone calls, and emails) are recorded, stored, and may be used as evidence in any dispute, legal proceeding, or regulatory complaint. By using DRIGO's support channels, the Client consents to such recording.
C. Graduated Consequences: DRIGO applies the following graduated enforcement for communication violations:
1. First Offence: Written warning issued via the App or Email. The Client's account may be temporarily suspended for up to 24 hours;
2. Second Offence: Account suspension for 7 days. The Client remains liable for all outstanding fees during the suspension period;
3. Third Offence: Permanent account termination and ban from all DRIGO services. All outstanding debts, fines, and penalties remain fully payable. DRIGO reserves the right to pursue legal action and report the matter to UAE authorities.
D. Immediate Termination (No Warning): The following severe violations will result in immediate permanent ban without prior warning:
1. Death threats or threats of physical harm;
2. Racial slurs, hate speech, or discriminatory abuse;
3. Sexual harassment or sexually explicit messages;
4. Doxxing or sharing personal information of DRIGO staff.
*Note: In such cases, DRIGO will file a formal complaint with UAE Police and provide all recorded evidence. The Client remains liable for 100% of all outstanding dues.*
13.3. PENALTIES FOR MAJOR VIOLATIONS
To protect the fleet and ensuring fairness, the Client acknowledges the following specific penalties for severe breaches:
1. Sub-Leasing / Unauthorized Driver: Penalty of AED 5,000 + Full Liability for any damages.
2. Drunk/Drugged Driving: Penalty of AED 5,000 + Full Liability + Police Reporting.
3. Disconnecting Tracking Device: Penalty of AED 5,000 + Legal Prosecution. *Note: These penalties are strictly for major breaches that endanger life or property ("Fasad"), and are in addition to actual repair costs.*
13.3-A. TRANSFER OF LIABILITY IN CASE OF SUB-RENTAL
In addition to the penalty set out in clause 13.3(1) above, the Client expressly acknowledges and agrees that:
1. Sole and Absolute Responsibility: If the Client, in breach of clauses 3.4, 12.11 and 13.2(2), permits, allows, hands over, sub-rents, or in any way transfers the use of the DRIGO Vehicle to a third party (whether for consideration or not, and whether such party is a friend, relative, or any other person), the Client shall remain solely and absolutely liable for any and all consequences arising from the use of the Vehicle by that third party.
2. Acts of the Third Party: Any traffic violation, fine, black point, accident, damage, theft, criminal act, third-party injury, blood money (Diya), bodily harm, death, or any other loss, liability or claim — civil, criminal, regulatory, or financial — caused by, contributed to, or arising in connection with the third party's possession, use or operation of the Vehicle, shall be deemed to have been caused by the Client personally.
3. No Defence: The Client shall not be entitled to raise the involvement of the third party as a defence, mitigation, or apportionment of liability against DRIGO. The Client waives any right to require DRIGO to pursue or seek recovery from the third party.
4. Voiding of Insurance: The Client acknowledges that sub-rental immediately voids all insurance coverage for the Trip Period. The Client is therefore liable for 100% of all damages, repair costs, third-party claims, and recovery costs, in addition to the penalty under clause 13.3(1).
5. Indemnification: The Client agrees to fully indemnify, defend and hold DRIGO harmless against any and all such claims, costs and losses on a continuing basis, regardless of when they become known.
13.3-B. AGGRAVATED MISCONDUCT (DRIFTING, HOOLIGANISM, GPS TAMPERING, THEFT)
In addition to (and not in substitution for) the penalties already set out in clauses 13.3 and Schedule A, the Client expressly acknowledges and agrees:
1. Drifting & Hooliganism: Use of the Vehicle for drifting, donuts, burnouts, street racing, stunt driving, or any reckless or hooligan conduct endangering the public shall attract an aggravated penalty of AED 10,000, together with full compensation for all damages sustained by the Vehicle (including mechanical, tyre, suspension, body and depreciation losses), loss of use, and all legal and recovery costs.
2. Aggravated GPS / Telematics Tampering: Any physical damage to, removal of, or deliberate interruption of communication with the GPS, telematics or tracking devices installed in the Vehicle (including but not limited to disconnecting, jamming, covering, or otherwise interfering with the device's connectivity) shall attract an aggravated penalty of AED 10,000, in addition to the full cost of restoration or replacement of the device and the cost of any operational loss caused by the resulting loss of fleet visibility.
3. Theft of Vehicle: Where the Client fails to return the Vehicle, retains it without authorisation, or otherwise commits any act constituting theft or misappropriation of the Vehicle under UAE Law, the Client shall be liable for a penalty of AED 4,000, plus the full cost of recovery, restoration, and any depreciation or loss of revenue suffered by DRIGO until the Vehicle is recovered and restored to service. DRIGO shall in all such cases report the matter to the UAE Police, and the Client remains liable irrespective of the outcome of any criminal proceedings.
4. Cumulative Application: The penalties under this clause 13.3-B are cumulative with, and in addition to, the penalties listed in clause 13.3 and Schedule A §3 of this Agreement, and do not relieve the Client from liability for actual repair costs, insurance excess, or any other liability arising elsewhere in this Agreement.
13.3-C. IDENTITY FRAUD AND FORGED DOCUMENTS
The Client warrants that all identity, residency, and driving-licence documents submitted during registration belong to the Client personally and are genuine, valid, and unaltered. The following constitutes a severe breach and an act of fraud:
1. Use of Another Person's Documents: Registering, verifying an account, or renting using the identity, Emirates ID, passport, or driving licence of any other person;
2. Forged or Altered Documents: Registering or renting using any forged, counterfeit, altered, or otherwise fraudulent document.
Consequences: Any such act shall result in immediate permanent termination of the account, a contractual penalty of AED 5,000, and the Client's full and personal liability for all charges, fines, damages, and losses arising from any rental made under the fraudulent registration. Any rentals or bookings made under such registration are void. The Client and the actual document holder shall remain jointly and severally liable.
Criminal Liability: The Client acknowledges that the use of another person's documents or of forged documents is a criminal offence under the laws of the United Arab Emirates. In addition to DRIGO's contractual penalties set out above, the Client shall remain subject to all criminal penalties imposed by the State and the competent UAE authorities (including imprisonment, fines, and any other sanctions provided by law). DRIGO will, in all such cases, report the matter to the UAE Police and provide all available evidence, and the Client remains liable irrespective of the outcome of any criminal proceedings.
13.4. PROHIBITED CARGO, SMOKING, AND HYGIENE STANDARDS
A. PROHIBITED CARGO AND TRANSPORTATION LIMITS To prevent damage to the vehicle's interior and mechanical systems, the Client is strictly prohibited from transporting:
1. Illegal & Hazardous Items: Narcotics, alcohol, weapons, explosives, flammables, or any contraband prohibited by UAE Law.
2. Bulky or Damaging Loads: Construction materials, heavy furniture, sharp objects, or any cargo that exceeds the vehicle's capacity or risks tearing the upholstery, scratching the interior, or damaging the roof lining.
3. Commercial Goods: Transporting goods for commercial delivery purposes is prohibited unless explicitly authorized.
B. STRICT NO-SMOKING AND HYGIENE POLICY The Client must return the vehicle in a clean condition, ready for immediate use by the next customer.
1. Smoking Ban: Smoking of any kind (including cigarettes, e-cigarettes, vape, and dokha) is STRICTLY PROHIBITED inside DRIGO vehicles.
2. Odor Control: Transporting items that leave strong, lingering, or offensive odors (e.g., fresh fish, heavy spices, wet pets, chemical substances) is forbidden.
3. Waste & Soiling: Leaving behind food wrappers, bottles, organic waste, or spilling liquids that result in stains or stickiness is a violation of this policy.
C. UNSANITARY CONDITION PENALTY If the vehicle is returned in an unsanitary or unacceptable condition (requiring deep cleaning or specialized deodorizing due to smoke/odors), the Client shall be liable for:
1. Special Cleaning Fee: As per the Schedule of Fees (covering professional detailing); AND
2. Loss of Use: Compensation for the time the vehicle is grounded for cleaning and unavailable for rent.
D. MECHANISM OF PROOF (COMMUNITY REPORTING)
The Client acknowledges that DRIGO relies on reports from subsequent users to maintain fleet standards.
1. The Rule: If the *next* user reports smoke smell, trash, or damage immediately upon accessing the vehicle (before starting their trip), the Previous Client will be presumed responsible.
2. Self-Protection: To avoid liability, the Client MUST inspect the vehicle upon entry. If the vehicle is not in a clean condition, the Client must report it via the App before driving. Failure to report implies acceptance of the vehicle's condition.
13.5. STANDARD OPERATIONAL PENALTIES
In addition to the Major Violation Penalties listed in Section 13.3, the following standard operational penalties apply to common breaches. These amounts are fixed and shall be charged automatically to the Client's payment method on file:
1. In-Vehicle Smoking: A flat penalty of AED 500 shall apply for each instance of smoking inside the vehicle (cigarettes, e-cigarettes, vape, dokha, or any other form). Detection is based on odor inspection, visual evidence (ash, burns), or reports from subsequent users.
2. Returning the Vehicle Unclean: If the vehicle is returned in a dirty condition requiring cleaning, a penalty of AED 100 to AED 500 shall apply, depending on the severity of the soiling as assessed by DRIGO staff. *Note:* Severe contamination (deep stains, vomit, pungent odors, pet mess) may be subject to additional charges as defined in the Schedule of Fees.
3. Damage to the Vehicle: In the event of any damage to the DRIGO vehicle, the damage shall be professionally assessed and the Client shall be liable for the resulting repair cost together with any applicable administrative fee. Detailed liability rules are governed by Sections 8 (Premium Insurance Coverage), 9 (Damage), and the Insurance Excess provisions.
4. Failure to Return the Vehicle Key: Upon trip end, the Client must return the vehicle key (where applicable) to its designated location. If the key is not returned:
a) Within 3 days: The Client shall be charged the full daily rental fee for each day the key is held beyond the trip end, as the vehicle remains immobilized and unavailable for rent;
b) Beyond 3 days (or non-return): A flat replacement and re-keying fee of AED 900 shall apply, in addition to the accrued daily rental charges.
5. Wrong Emirate Parking (Out-of-Zone Return): DRIGO operates exclusively within the Emirates of Dubai and Sharjah. Returning the vehicle outside its assigned operational zone shall result in the following penalties:
a) Cross-zone within operating Emirates (Dubai vehicle left in Sharjah, or Sharjah vehicle left in Dubai): AED 200;
b) Outside operating Emirates (Abu Dhabi, Ajman, Ras Al Khaimah, Fujairah, Umm Al Quwain): AED 400.
*Note:* These penalties are in addition to any towing, recovery, or relocation costs incurred by DRIGO to return the vehicle to its designated zone.*
14. FEES AND INVOICING
14.1. TRANSPARENCY OF FEES
Fees, fines, and penalties are detailed in the "Schedule of Fees" (Schedule A) available on the DRIGO App/Website. Strict Policy: Unlike other providers, DRIGO does NOT apply fees based on arbitrary discretion. All charges applied to invoices will be strictly in accordance with:
1. The published Schedule of Fees; OR
2. Actual costs incurred by DRIGO (e.g., actual repair bills, traffic fines). The Client has the right to request a breakdown of any charge applied.
15. PRIVACY POLICY AND DATA PROTECTION
15.1. SCOPE AND CONSENT
This policy governs your use of the "DRIGO" Application. By registering, you consent to the processing of your data in accordance with UAE Data Protection Laws and Sharia principles of privacy ("Hurmah").
15.2. INFORMATION COLLECTION
1. User Provided: We collect name, Emirates ID, license details, and payment information to facilitate the rental.
Note on Payment: DRIGO does NOT store your raw credit card details. Payments are processed via a secure, PCI-DSS compliant third-party gateway.
2. Automated Data: We collect device ID, IP address, and usage statistics to improve app performance.
15.3. GPS TRACKING AND LOCATION SHARING
To ensure the safety of the fleet and the Client ("Amanah"), DRIGO vehicles are equipped with GPS trackers. Who sees your location?
1. Internal Staff: For asset monitoring and recovery.
2. Authorities: Police or emergency services in case of accidents or theft.
3. Restriction: We do NOT share your real-time location with other users or unauthorized third parties. Your privacy is paramount.
15.4. DATA DISCLOSURE
We will strictly share your information only:
1. Legal Requirement: If required by a court order, police investigation, or subpoena.
2. Safety & Fraud: To protect rights, safety, or investigate fraud/theft.
3. Business Transfer: If DRIGO undergoes a merger or sale, you will be notified of data transfer.
15.5. CHILDREN'S PRIVACY
DRIGO does not knowingly solicit data from children under 18 (driving age). If such data is found, it will be deleted immediately.
15.6. SECURITY AND STORAGE
We use industry-standard physical and electronic safeguards to protect your data. Location of Data: Data processing takes place primarily in the United Arab Emirates and/or secure global cloud servers (e.g., AWS/Google Cloud) compliant with international security standards.
15.7. CHANGES TO POLICY
Any updates to this policy will be notified via the App. Continued use of the Service constitutes acceptance of the new terms.

16. ACKNOWLEDGMENT AND DIGITAL CONSENT
16.1. DECLARATION OF UNDERSTANDING
By clicking the "I AGREE" button (or signing physically), the Client explicitly declares and confirms that:
1. Read & Understood: I have read this entire Agreement, including the Terms of Use, Insurance Policy, Privacy Policy, and Fees Schedule.
2. No Hidden Terms: I understand that there are no verbal agreements or hidden clauses outside this written contract.
3. Liability Acceptance: I fully understand my financial liabilities regarding Insurance Excess, Traffic Fines, and Vehicle Damage as explained in Sections 8, 9, and 10.
4. Sharia & Legal Compliance: I acknowledge that this Agreement is drafted to ensure fairness and transparency in accordance with UAE Laws.
16.2. DIGITAL SIGNATURE (E-SIGNATURE)
In accordance with the UAE Federal Law on Electronic Transactions and Trust Services:
- My action of checking the box ["I accept the Terms and Conditions"] and clicking ["Confirm Booking"] within the DRIGO App constitutes a legally binding Electronic Signature.
- This Electronic Signature has the same legal validity and enforceability as a handwritten signature.
